Bei Unfall im Pflegeheim muss Krankenkasse Kosten zahlen
Klage auf Schadensersatz der gesetzlichen Krankenversicherung abgewiesen
Immer mehr alte Menschen werden heute in Heimen untergebracht, um dort ausreichende medizinische Hilfe und Pflege zu erhalten. Immer häufiger geschieht es jedoch, dass Betreute in Pflegeheimen Verletzungen erleiden, die anschließend medizinisch behandelt werden müssen. In derartigen Fällen müssen natürlich die jeweiligen Krankenkassen die Arzt- und Krankenhauskosten tragen, da sie für die Begleichung derartiger Kosten einstehen. Allerdings fühlen sich immer mehr Krankenkassen nicht mehr verpflichtet, diese Leistungen zu begleichen, insbesondere dann, wenn die Pflegeheime die Unfälle oder Verletzungen mit verschuldet haben.
Jetzt beschäftigte sich auch das Oberlandesgericht Bamberg mit der Frage, ob und wann ein Pflegeheim zur Begleichung von Krankenhauskosten in Anspruch genommen werden kann. Im konkreten Fall stürzte eine 83jährige Heimbewohnerin beim Gang zur Toilette. Sie wurde dabei lediglich von einer Pflegekraft gestützt. Durch den Sturz zog sich die Bewohnerin einen Oberschenkelhalsbruch zu, dessen Behandlungskosten von der Krankenkasse mit 7.000 Euro angegeben wurden. Diese Kosten wollte die Krankenkasse nun vom Pflegeheim einklagen, da dieses nach Ansicht der Versicherung seine Sorgfaltspflichten verletzt habe.
Das Oberlandesgericht urteilte jedoch, dass die Pflege von Heimbewohnern nur mit einem im Verhältnis stehenden finanziellen und personellen Aufwand möglich ist. Die Pflege muss dabei auch die Würde, die Interessen und die Bedürfnisse der Bewohner der Pflegeheime berücksichtigen. Die Klage der Krankenkasse wurde daher abgewiesen, denn eine besondere Schwere der Beeinträchtigung der Verletzten konnte nicht belegt werden. Zudem hatte die Bewohnerin den kurzen Gang zur Toilette auch bisher ohne Probleme bewältigt. Die Berufung der Krankenkasse war ebenfalls erfolglos.
